These Terms and Conditions ("Terms") govern your use of our managed Moodle hosting services and website, accessible at https://www.moodleoasis.com. By accessing or using our website and services, you agree to comply with these Terms and Conditions. If you do not agree with any part of these Terms, you must not use our services.

[1] Acceptance of Terms
By accessing, browsing, or using our services, you agree to comply with and be bound by these Terms, as well as any additional terms, policies, or guidelines posted on our website. If you do not agree to these Terms, please do not use our services.

[2] Services Provided
Moodle Oasis provides managed Moodle hosting services, including but not limited to different hosting packages, domain registration, and other related services ("Services"). Detailed descriptions of the Services offered can be found on our website.

[3] Account Registration and Security
To use certain Services, you must create an account with us. You agree to provide accurate, current, and complete information when registering for our Services. You are responsible for maintaining the confidentiality of your account credentials (username and password) and for all activities that occur under your account. You must immediately notify us of any unauthorized access or use of your account.
[3.1] Stripe Approval Requirement
(a) To accept payments via Moodle Oasis, users must complete Stripe's onboarding process and receive approval from Stripe.
(b) Moodle Oasis does not control Stripe's approval decisions, which are subject to Stripe's terms and eligibility criteria.

[4] Billing and Payment
[4.1] Fees:
(a) You agree to pay all fees associated with your selected Services as specified on our pricing pages.
(b) For payments processed through Stripe, a 2% transaction surcharge will be applied to all payments.
(c) All fees are exclusive of applicable taxes, which will be added to your invoice where required by law.
[4.2] Payment Terms:
(a) Payments are due in advance for the Service period (e.g., monthly, annually).
(b) You must maintain valid payment credentials on file.
(c) Failed payments may result in service suspension after 7 days.
[4.3] Late Payments: If payment is not received on time, we reserve the right to suspend or terminate your Services. Reinstating services may incur a reinstatement fee.

[5] Refunds
[5.1] As our cloud hosting services operate on a prepaid monthly basis, refunds are only applicable for the remaining unused portion of the current billing cycle. The refund amount will be calculated on a pro-rata basis from the cancellation date to the end of the monthly period.
[5.2] If a customer fails to gain Stripe approval and no longer wishes to use Moodle Oasis hosting services, they may request a full refund within 7 days of purchase, provided:
(a) No Moodle instance has been deployed.
[5.3] If a customer has already utilized hosting resources (e.g., server provisioning, domain setup), refunds will be prorated or denied at Moodle Oasis's discretion.

[6] Payouts
Stripe is solely responsible for payouts to your designated account per their terms.

[7] User Obligations
You agree to use our Services in accordance with all applicable laws and regulations. You are solely responsible for any content you upload or host on our platform. You will not use our Services to:
(a) Violate any laws or regulations.
(b) Engage in fraud, spamming, phishing, or any unlawful activity.
(c) Delivering content which promotes political, interfaith disharmony, sectarian, anti-state activities.
(d) Violate the intellectual property rights of others.
(e) Use excessive server resources or interfere with the operation of our servers.

[8] Acceptable Use Policy
You agree not to engage in any activities that negatively affect the performance or security of our platform, including but not limited to:
(a) Sending unsolicited emails (spam) from your hosting account.
(b) Hosting or distributing illegal or copyrighted content without proper authorization.
(c) Engaging in activities that degrade our server performance or security.
A violation of this Acceptable Use Policy may result in suspension or termination of your account without refund.

[9] Termination of Services
We reserve the right to suspend, restrict, or terminate your Services if you violate any terms outlined in this Agreement, including the Acceptable Use Policy. You may terminate your account at any time by providing us with written notice. Termination will not relieve you from paying any outstanding fees owed to us.

[10] Ownership of Content
You retain ownership of all content you upload or create while using our Services. However, by using our Services, you grant Moodle Oasis a worldwide, royalty-free, and non-exclusive license to store, use, and display such content to provide the Services to you.

[11] Disclaimer of Warranties
We provide our Services using commercially reasonable care and skill. However, given the nature of cloud hosting:
(a) Temporary interruptions may occur for maintenance, upgrades, or force majeure events.
(b) You acknowledge that no online service is completely immune to outages or security risks.
(c) We recommend to have your local copy of contents you upload on your Moodle hosting site.

[12] Limitation of Liability
To the fullest extent permitted by law, Moodle Oasis will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our Services, even if we have been advised of the possibility of such damages.

[13] Indemnification
You agree to indemnify, defend, and hold harmless Moodle Oasis and its affiliates, directors, employees, and agents from and against any claims, losses, damages, liabilities, or expenses arising from your use of the Services or any violation of these Terms.

[14] Privacy Policy
By using our Services, you agree to our Privacy Policy, which outlines how we collect, store, and use your personal information. Please review our Privacy Policy to understand your data rights and how your information is protected.

[15] Changes to the Terms and Conditions
